Whereas, the Right to Fair Compensation and Transparency in Land Acquisition  Rehabilitation  Resettlement Act  2013 No.30 of 2013  here as after called as  the Act, and has been enacted by the Parliament and published by Govt of India bringing into force with effect from 1/01/2014.
And whereas, the Govt of India have promoted widely an Ordinance called the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation Resettlement Ordinance 2015 amendment No.4 of 2015 amending the Act.
The Municipal Administration & Urban Development Department have sent a proposal to exempt the Capital City Development Project within the limits of Andhra Pradesh Capital City Area as declared under G.O.Ms.No.254, MA&UD(M2) Dept, dt .30/12/2014 from the application of the provisions of the Chapter-II and Chapter-III of the said Act.
Now, therefore, in exercise of the powers conferred under sub-section (1) of section 10A Act, and amended by the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Amendment) Ordinance, 2015 (Ordinance No.4 of 2015), Govt after careful examination, issued the following notification which shall be published in the Extra-ordinary issue of the Andhra Pradesh Gazette, dt. 15/05/2015.
The notification has been published in the Andhra Pradesh and planned to supply 250 copies (both in Telugu and English).
The Municipal Administration & Urban Development Dept, AP and the District Collector of Guntur will take necessary action accordingly.

AP who is leaving the Hyderabad to Telangana, and planned  the new capital near Vijayawada at an estimated cost of over Rs 13,500 crore but hurdles have cropped up over land pooling issues with farmers.
The committed capital city of Amaravathi, the ancient Satahavanas Kings, 80 km from Vijayawada, has been zeroed upon by the AP govt, which has worked out the plan with a Singapore firm and the public sector National Building Construction Corporation (NBCC).
33,000 acres of land, mostly cultivation land, is being acquired by the government from farmers in coastal Guntur and Krishna districts for the new capital, which will have a spanking new Secretariat and a legislature complex including the assembly and council, Raj Bhavan and residential quarters for employees.
The govt would go for land acquisition in case it fails to get agreements done with all the farmers who "offered" their land for the capital city.
Infrastructure Corporation of AP and International Enterprise, Singapore, signed an MOU according to which both the parties will "cooperate in the master-planning, development and construction of the capital city of Andhra Pradesh as a modern, vibrant, sustainable and smart capital city with a strong economy, excellent social amenities and efficient transport and logistics networks.
The 7325 sq km of area for the Capital Plan is the first of a three-stage master plan for the capital city.
In a controversial move, the Andhra Pradesh government on Thursday issued a GO exempting the capital city development project from the provisions of Chapter III of the Land Acquisition Rehabilitation Resettlement Ordinance 2015. The ordinance which was affected by the NDA govt at the Centre brought in some changes to the same Act that was passed by the previous UPA regime in 2013 and came into effect on 01/01/2014.
Chapter III of the Land Acquisition Act states that no irrigated multi-cropped land shall be acquired under the Act, which allows that the land acquisition under exceptional circumstances as a demonstrable last resort. AP government is in the view that the land acquisition for the capital region is being done under exceptional circumstances. The municipal administration and urban development (MA&UD) ministry has issued  the notification for acquiring the land under the land acquisition act on 16/05/2015.
The notification is clearly stating that the land acquisition act will be invoked only against those who are not willing to part with the same under the land pooling system. Out of the 33,000 acres that is needed for the capital region development, the state has been  acquired most of the land by the land pooling system and another 1,300 acres is in need, for that the land acquisition Act is being invoked. The management are hopeful that once the notification is issued and before the process begins, and the farmers should  come forward to part with their land under the land aquisition system, under which they stand to get a higher compensation as compared to the benefits laid down in the land acquisition Act.
